VALENCIA, Aug. 2, 2007 (KABC-TV) (KABC) -- We have an update on a story we've been following about a self-described pedophile who police can't arrest because they say he hasn't done anything yet. But now some concerned parents are taking action.
Jack McClellan is a self-described pedophile. He's been in the area and taken pictures of little girls and posted them on his Web site. It's what he's written on that Web site that has outraged parents and gotten a couple of area lawyers to take action. They're hoping a judge will see it their way, to keep McClellan away from the area.
"All I can say is I've done nothing illegal since I've been here in California, the whole state. My conscience is clear. I'm just going to keep on keeping on what I'm doing, obeying the law," said Jack McClellan.
Jack McClellan says he's a pedophile who takes pictures of little girl and posts them on his Web site where he describes his attraction.
That's what's prompted the Santa Monica Police Dept. last week to pass out fliers warning parents that he's been spotted in the area.
It has also prompted two Santa Clarita lawyers, Anthony Zinnanti and Richard Patterson, both dads, both with daughters, to take the charge of attempting to obtain a temporary restraining order to keep McClellan away from the Santa Clarita Valley area.
"We're firmly convinced that he creates a clear and present danger and a risk to our daughters and to the children in this community, and he stated that he's coming back," said Patterson.
McClellan claims to have no criminal record. His Web site advocates legal, consensual non-sexual contact with little girls.
"I've never done anything illegal with girls," said McClellan.
Zinnanti says McClellan has broken the law.
"What we're looking to do is to restrain the behaviors. It's not OK to go out and secretly take images of little kids. It's not OK to go out and put those images on the Internet. It's a blatant violation of the law. And furthermore, we're seeking to keep him away from areas and events where the primary activity is children services or entertainment when his presence is for the purpose of collecting information about the kids to disseminate or secretly take pictures of the kids," said Zinnanti.
Patterson and Zinnanti have a hearing scheduled for Friday morning at a courthouse in Chatsworth. That hearing is at 8:30 a.m. to see if a judge will grant them that temporary restraining order.
