LOS ANGELES (KABC) -- A Los Angeles judge Wednesday rejected a request to stop California's recently enacted ban on the sale of foie gras.
U.S. District Judge Stephen V. Wilson threw out the request for the temporary emergency injunction, saying it should have been made much earlier to be feasible.
The ban went into effect July 1 after animal-rights activists successfully convinced lawmakers that force-feeding ducks and geese through a tube to fatten their livers was cruel.
Despite the ban, fans of foie gras are finding ways around the new state ban on selling the rich delicacy.
One strategy used by some restaurant to keep serving the item is claiming exemptions under federal law to giving away the dish, since the law only bans the sale. One Los Angeles restaurant is even preparing duck livers that customers bring in.
Locally, L.A. County's Health Department says it will inspect any restaurant reportedly serving foie gras.
