Jason Shirley's Trial Begins Next Month

A Fresno judge has dropped his threat to arrest former Fresno State football player Jason Shirley.

Shirley appeared before the judge after missing a court appearance last week. The judge said he'd put out an arrest warrant if Shirley didn't show up.

He's accused of driving drunk and crashing into a Fresno apartment. His first trial ended with a hung jury.

Shirley's defense team is trying to delay the trial until after football season & So Shirley can play for the Cincinnati Bengals.

Charles Magill Shirley's Defense Attorney said, "It's clear this is not only on Jason Shirley but also on Fresno State. In the last trial, we had Pat Hill testify, I expect to have him testify again. I have a variety of influential people at Fresno State's football team subpoenaed."

The prosecution refused to delay the trial. Shirley is scheduled to go to trial next month in the middle of the NFL season.
