No jail time for Washington Union teacher who admits to sex with student

FRESNO, Calif. (KFSN) -- A former Washington Union teacher who admits to having sex with a 15-year-old student won't serve any jail time for it, and the victim is happy about it.

Nadia Diaz was sentenced to probation Friday.

The boy is now 18, but since he's the victim of a sex crime, we're not identifying him.

This afternoon, he said he'd feel like it was his fault if the former teacher's life was ruined.

Nadia Diaz walked out of the courthouse, turned away from an Action News camera and went on with her life.

The 27-year-old will serve three years of probation and attend sex offender mental health treatment.

But otherwise, her life won't change much despite a felony conviction for having sex with a student while she was a sub at Washington Union high school.

And the teen victim -- who was a 15-year-old sophomore when it happened -- says that's all right with him.

"I personally feel that this is one of the rare cases where it shouldn't be taken as child abuse," the victim said.

Now 18, the victim told a judge he wanted the minimum punishment for Diaz.

He said he was the aggressor and apologized to the former teacher.

"I believe 100% that Mrs. Diaz made a big mistake and definitely after we had ended whatever relationship we had, she realized it," he said.

But the teen's mother says her son and her entire family have suffered since discovering the relationship.

She said children should be safe at school, and she got upset when the judge said Diaz would not have to register as a sex offender.

But her attorney says the punishment fits the crime.

"Was she treated differently than a male teacher would've been?" an Action News reporter asked him.

"You know, that's a big controversy and I think reasonable people would conclude there are differences between men and women in certain circumstances," said Rick Berman.

For her part, Diaz said nothing except yesses and nos in court, but in a letter she told the judge she felt shame, guilt, remorse and extreme embarrassment about her crime.

Diaz will now lose her teaching certificate, which was already suspended.

But she has a new job now, and the judge even ruled she can attend school functions if she's with family members.
