Judge to say where BART shooting trial to be held

An Alameda County judge is scheduled to announce on Thursday where the murder trial will be held for a former transit officer charged in the killing of an unarmed man.

Superior Court Judge Morris Jacobson is expected to say whether the trial of Johannes Mehserle will take place either in Los Angeles or San Diego counties.

State court officials recommended the two sites as possible choices after Jacobson ruled last month that Mehserle could not get a fair trial in Alameda County.

Jacobson cited extensive media coverage, fears of shielding jurors and witnesses from any possible civil unrest.

The 27-year-old Mehserle is charged with the shooting of 22-year-old Oscar Grant at a Bay Area Rapid Transit station on New Year's Day.

He has pleaded not guilty in the case.
