EXCLUSIVE: Houston attorney to help Anna Nicole Smith's mom win custody of her daughter

(2/14/07 - KTRK/HOUSTON) (KTRK) -- A well known Houston attorney is on his way to Florida to help Anna Nicole Smith's mom fight for custody of Smith's infant daughter.

Sources tell us this could turn into a fight, not just over Smith's daughter, but her body as well as the body of her son Daniel, who died last year.

Well-known Houston attorney John O'Quinn flew to Miami Wednesday night for a probate court hearing at 9:30am Thursday in Fort Lauderdale.

The plan is to go to court and fight for custody of Anna Nicole's Smith's body to bring her back here to Houston for burial. And the fight won't stop there. It may take them to the Bahamas.

ABC News was first to talk to Virgie Arthur when she traveled to the Bahamas last week. She has made no secret of the fact that she wants custody of Smith's five-month-old daughter, Dannylynn. Now she also wants the body of Smith's son, Danny, who was buried in the Bahamas, to be exhumed and also brought back here to Houston to be buried with Anna Nicole.

As for attorney John O'Quinn, his name has been linked to controversy involving the 25 story St. Lukes Medical Tower. The building's new name is the O'Quinn Medical Tower at St. Lukes. The name change is thanks to a $25 million donation from O'Quinn who has made much of his fortune on medical malpractice lawsuits.

That Florida probate court judge ruled that Anna Nicole Smith's body will be held until the hearing Thursday morning. A decision on who gets the body and when could be made at that hearing.
