A state district judge from Houston who once called the death penalty unconstitutional is leaving the bench.

Judge Kevin Fine resigned Tuesday. The judge gave no reason for the resignation. We're told that Judge Fine had an opportunity come up that may not be there later, so he took the leap now.

Judge Fine stirred up controversy two years ago when he ruled the death penalty unconstitutional because it was his belief that innocent people were executed.

Harris County commissioners court will name Fine's replacement.
