Second suspect in Lone Star College shooting arrested in Plano, returned to Houston

  

HOUSTON (KTRK) -- The man police call a second suspect in the Lone Star College campus shooting spoke for the first time since chaos erupted Tuesday on campus.

Trey Foster was arrested in Plano early Friday morning without incident and arrived back in Houston around 6:30am, where he was questioned by the Harris County Sheriff's Office. He was later moved to the Harris County Courthouse.

In between, Foster was asked by reporters what led to the campus shooting, to which he simply replied, "Someone bumped me."

Late Friday afternoon, Quanell X said he got more details from Foster.

"Mr. Foster said to me that he said to the young man, 'Look, I don't want any trouble.' And when he said, 'I don't want any trouble,' he turned to the side and said the young man swung on him," he said. "He pulled out his gun and he shot."

Officials tell Eyewitness News that Foster, 22, was tracked by the Gulf Coast Violent Offenders Task Force to a friend's house in Plano where he was arrested at around 1:20am, after successfully dodging authorities since Tuesday's shooting. Plano police and the East Texas Fugitive Task Force assisted in the arrest.

Investigators also say a semi-automatic pistol was recovered during the arrest, but pending tests will confirm whether that was the gun used in the shooting, Harris County Sheriff Adrian Garcia said.

"He claims to have legally purchased this firearm at a sporting goods store. This is being investigated He claims to be a concealed handgun license holder. This has been investigated and there is no evidence to support this claim," Garcia said. "He has indicated he always carries the gun."

The other suspect, a Lone Star College student identified as Carlton Berry, is already in custody. The two acquaintances are both charged with two counts of aggravated assault.

Authorities say they still don't know which man fired the gun, so the charges against both suspects will remain the same until the sheriff's office and district attorney's office figure it out.

"I don't know who was holding the weapon. They are still trying to interview all of the witnesses to be able to determine what they know about where the weapon was and who was holding the weapon," Assistant District Attorney Alison Baimbridge said on Thursday.

According to court documents, Foster and Berry were walking on the Lone Star College North Harris campus at around noon Tuesday when another man, Jody Neal, bumped into Foster and an argument ensued. The three men ran into each other about a half-hour later, and that's when court documents state either Foster or Berry pulled out a gun and started shooting.

About 10 shots were fired in a courtyard, sending students running for cover. Neal, who was working on getting his GED, was shot in the leg and abdomen. Deputies say he ran to the library and collapsed.

A maintenance man, 69-year-old Bobby Cliburn, was nearby and was hit.

"Mr. Berry also suffered a gunshot wound. It is unknown at this time if he shot himself or was shot by the other suspect," said Baimbridge.

Investigators say Neal initially identified Berry as the gunman. But one day later, he changed his story saying Foster pulled the trigger and Berry was just with him.

"I want justice. My son is innocent, and I want him to be released," said Berry's mom, Sharonda Felix.

On Friday afternoon, Felix showed up to Harris County Jail with Quanell X.

Felix claims her son had nothing to do with the shooting and is wrongfully charged with aggravated assault.

"It's just heartache and pain. We just stay prayed up, and give all the glory to God. Everything is going to be OK," Felix said.

Court documents state Neal's description of Foster and Berry matched video footage from the campus.

Investigators say it appears one of the suspects and one of the victims have known gang affiliations, but that didn't appear to be a factor in this case.

Berry is due in court on January 30.

The Lone Star College System has an enrollment of 90,000 students and six college campuses, according to its website. Its North Harris campus is about 20 miles north of downtown Houston.
