AUSTIN, TX -- A Central Texas man faces up to life in prison over the 2010 death of his 2-year-old nephew who was critically hurt while in his uncle's care.
A jury in Austin on Friday considers the penalty for 26-year-old Mark Paniagua.
The panel on Thursday convicted Paniagua of murder with a deadly weapon.
Prosecutors say Paniagua was upset with Carlos de la Rosa when the child cried and kept asking to go outside and play. Authorities say Paniagua shook the boy, threw him into a room and on a mattress while baby-sitting the child and five other youngsters at the man's home in Austin.
Doctors say Carlos suffered blunt force injuries and died at a hospital.
Paniagua did not testify during his trial.
