Bay Imaging owners back in court
(New York-WABC, July 23, 2007) (WABC) -- A doctor behind a radiology clinic accused of keeping more than 100,000 women from getting their medical records faced a judge Monday answering contempt charges.

It was judgement day for the owner of a failed Brooklyn mammography clinic. His former patients had been trying in vain to get their mammograms from him and a judge had ordered him to provide them. But when many women were still without their images, the judge sent the doctor to jail.
Doctor Ruben Fleurantin and his brother, Aram, were led from court in handcuffs today. The Fleurantins were found in contempt of court for not providing mammograms to tens of thousands of patients.
"I went down to the Fluerantins, filled out a form and they couldn't find them," said Rosalie Barba-Klonsky, a mammography patient.
The Fleurantins ran Bay Imaging until it was shut down by the city last summer for not having a radiologist who could read mammograms on staff. Seven On Your Side found some of the mammograms stored in basements and in deserted offices that were shutdown due to foreclosure.
The Fleurantins had been ordered by a judge earlier this month to provide the mammograms to the women who requested them.
After the last court hearing, we went with three women to try to get their images. They were turned away by an angry Dr. Fleurantin.
"This is negligence ... and inadequate service," Marie Garcon said.
Marie Garcon got some, but not all of hers the next day. Many other women did not.
After the Fleurantins were led off to jail this afternoon, their former patients now wondered who was going to get their mammograms to them.
Dr. Fleurantin maintained that he was 100 percent compliant with the court order, even though four women testified that they had tried and been unable to get their mammograms.
The Fleurantins were found guilty of criminal contempt and face up to six months in jail and $5,000 dollars a day in fines.
