1. Should Jury Duty be optional?
Jury duty is a service to our community. There should be one exception to the rule that can be waived by the individual requesting the wavier be removed.
First lets exempt all those who have served our community - Veterans of the Armed Services. They put their lives on hold and served our county. Let's honor them by not forcing them to serve on Jury duty unless they volunteer.
2. Should the Clerk of the Circuit Court Office be Elective or Appointed?
This question steams from the law suit between the Clerk and the Chairman of the board and the county board that cost the tax payers over $500,000.00.
That law suit was created by the lack of control the County Board has over the Clerk. If the Clerk was appointed he or she would face the possibility of being fired if he or she stood up to the Board.
That being said the reality of an appointed Clerk would force the Board to understand the law prior to forcing the Clerk's hand to appease the boards needs solely.
The Clerk's office is run based upon current laws. So If the clerk was appointed there would have to be a clear understanding by the members of the County Board as to what the Clerk can and can't due. The Board would be held accountable to the law not the Clerk. It would only be the Clerks job to advise the Board as to what's legal. The Board could involve either the District Attorney or the Chief Justice for advice. Their advice would put them in the legal line of fire. How many of you think they will want that to occur?
This office needs to be run by a business person as a business. That person should have the independence of not being subjected to potential threats of being fired. This person should be a professional person following the law with the best interest of the tax paying citizens in mind at all times. This person should be elected by the tax paying citizens.
The Clerks office collects all the fines and fees of the County courts and pays them out to the legally defined payee. The office is subject to an audit or audits from an outside agency. The office has over 100 employees many of whom are in a union. These are the people who should be in control who becomes their Circuit Clerk.
3. What can the Clerk due to make the office function more efficiently?
First we need to realize the Clerk of the Circuit Court in Kane County is not alone in the state. There are many Clerks of the Circuit Court offices. There are many with the same size. That defines the size of the fines and fees. Ours and several others have populations in between 500,000 and 2 Million.
If we look at a company with many divisions that use the same set of operating rules we should be able to cooperate in developing better quality programs. In business we take the best platform ( Program base ) and get a committee composed of the expert from each division and have them improve the systems. ( e.g. on star, on board computers,improved inventory systems,Just in time) The Clerk of the Circuit Court in Du Page County has the best Computer system developed on government time by government employees. They are willing to give it to us. It will run on our computer. If we learn from one another's programming teams while working together to accomplish the goal of maintaining a stable platform system we could solve the problem faster.
Oh and did I tell you that would save the tax payers of Kane County 12.6 million dollars? If we don't start running the Clerks office like a business, the tax payers will pay that in addition to the anticipated 40 million for a new building. Both are unnecessary expenses at this time in my opinion.
4. What can I do to stream line operations and save tax payers money?
First don't spend the 12.6 million on a computer program bought from an outside company. We can get the program from Du Page county that will cost us $0.00 and it works!
Second don't spend 40 million on a building consolidation. Put the employee safety system in place and have a professional manager run the office.
5. What type of probation reform would I implement?
Whatever the State of IL. or the US Senate passes. The job of the Clerk is not to make the laws. The Circuit Clerk's job is to follow them. Probation between the employees and the Office of the Circuit Clerk is a matter of negotiation that should be monitored by someone who has experience managing people and negotiating contracts. I have managed several hundred employees simultaneously and negotiated deals professionally my entire career.
