Motorola trade secret thief Hanjuan Jin denied appeal

September 26, 2013 (WLS) -- A suburban woman convicted of stealing tens of millions of dollars in trade secrets from Motorola lost her appeal in the 7th circuit on Thursday.

Hanjuan Jin, arrested five years ago at O'Hare Airport with a one-way ticket to Beijing and thousands of confidential Motorola files, was sentenced to 48 months in federal prison.

The ABC7 I-Team has learned that Appellate Judge Richard Posner not only upheld Jin's sentence but states it should have been longer. Posner wrote, "given her egregious conduct, which included repeatedly lying to federal agents (for which she could have been prosecuted but was not), she was fortunate to be the recipient of discretionary sentencing lenity based on her ill health and inability to join her family, now in China."

Posner also said Jin was given a "surprising break" in sentencing despite having pleaded not guilty and going to trial.

Jin is serving her sentence in Carswell Federal Prison in Fort Worth, Texas.
