Doc: Wisconsin man who killed neighbor not delusional

Friday, July 19, 2013

A court-appointed doctor says a Milwaukee man who shot and killed his teenage neighbor last year over a suspected burglary didn't show signs of delusional behavior.

Dr. Robert Rawski said Friday that John Henry Spooner showed awareness of his environment when he killed 13-year-old Darius Simmons.

The 76-year-old Spooner was convicted Wednesday of first-degree intentional homicide. His trial is now in a second phase to determine whether he was mentally ill at the time of the killing.

Spooner testified Thursday that he killed Darius because he really wanted his stolen guns back. He said the killing was "justice" for the burglary. Police searched Darius' home after the shooting and didn't find the guns.

Jurors could return a verdict as early as Friday afternoon.
