The father of the 11 year old boy who was struck and killed by an Oregon bus is now suing the school district and the bus driver.

The father of the 11 year old boy who was struck and killed by an Oregon bus is now suing the school district and the bus driver.

This happened back in October. Police say Austin Takacs was late getting to the bus stop. And while running alongside of his bus, he tripped over his book bag and was struck by the bus. Tonight, his father is suing the Oregon school district and the bus driver for more than $2 million.

It was a sudden blow to the Oregon community. Last October, Austin Takacs' life was cut short after a terrible bus accident. The 6th grade athlete later died. That day, the bus driver Rita Grivanos, 68, was taken to St. Charles hospital to be treated for emotional distress. She wasn't cited at the time.

Now she's being named, along with Oregon city schools, in this lawsuit filed in Lucas County common pleas court by Austin's father. It alleges that driver Rita Grivanos was negligent when she struck and killed Takacs.

The lawsuit also claims that the district breached its duty to "provide transportation, to and from school, of students within its school district in a safe and cautious manner." The lawsuit asks for a $2-million judgment against both defendants, and $16,756 plus fees to pay for Austin's medical and funeral expenses.

Austin's father has declined comment through his attorney. We called the superintendent of Oregon schools several times today, but our calls were unanswered.
