Young had no cuts or scratches

Tuesday, February 14, 2012

Jason Young's defense team hammered on the lack of physical evidence against him Tuesday as it cross-examined an agent with the City-County Bureau of Identification.

Agent Mike Galloway was on the witness stand for a second day in Young's trial. He's accused of beating his wife Michelle to death in their south Raleigh home on Nov. 3. 2006. The 29-year-old was pregnant with the couple's second child when she died. Their first child - who was 2-years-old at the time - was found in a bed next to the body. She was unharmed.

Under cross-examination, Agent Galloway said Young came in to be photographed four days after the murder. Investigators took pictures of his hands, head, and neck. They found no indication of scratches, cuts, or bruises that might have shown Young struggled with his wife.

Michelle Young's sister Meredith Fisher found her lying in a pool of blood next to her bed the morning of Nov. 3, 2006. A medical examiner's report later said she had been beaten in the head some 30 times. Despite the large amount of blood at the crime scene, Galloway testified there was no evidence the killer took a shower or cleaned up inside the home. While investigators found an outside faucet running, tests on the tap and tests of the surrounding concrete were also negative for blood.

Galloway said a large amount of water or soap would have washed away the blood traces.

Prosecutors allege Jason returned from a business trip in Virginia in the middle of the night to kill his wife and then secretly returned to his hotel room in Hillsville. Young maintains he never left the hotel.

Galloway testified he helped search Young's vehicle and also travelled to look at Young's hotel room in Hillsville. Defense attorney Mike Klinkosum pressed on the fact Galloway found no blood in the hotel room or in Young's SUV.

"It's safe to say you scoured that entire vehicle ... and you found no blood," said Klinkosum.

Galloway agreed.

The prosecution has painted Young as an immature man who fought frequently with his wife and had multiple affairs. It alleges he tampered with a surveillance camera at his hotel and was spotted by a gas station clerk buying gas between Hillsville and Raleigh.

It's not clear if Young plans to testify in his own defense. It's his second trial. The first ended with a hung jury last June. At his first trial, Young took the witness stand and admitted he and Michelle were having problems, but said he was working on his marriage and didn't kill his wife.

The trial is expected to last several more weeks.
